It sounds like a nightmare, doesn't it? A homeowner, with years of hard work and sacrifice, finally pays off their mortgage, only to find someone unexpected on their property title.
This week's cautionary tale highlights the immense risks involved with adding anyone to your property title without fully understanding the legal and financial ramifications.
In a recent case I encountered, a well-meaning mother, whose home was entirely paid off, decided to help her adult son and his long-term girlfriend purchase their first home. The bank, citing the couple's limited income, suggested the mother co-sign on their mortgage. That's a common practice. However, here's where it went wrong:
- The bank's mortgage broker, perhaps inadvertently, advised that for the mother to co-sign the new mortgage, she would also need to be added to the title of their new home. This raised a red flag immediately.
- But the larger issue actually reversed direction. To 'help' the son and girlfriend get this new mortgage, the mother was ultimately advised by 'a friend' that she should refinance her OWN paid-off home to pull out equity, which would then be gifted to the son and his girlfriend for their down payment.
- Crucially, during this refinancing process of the mother's home, the son's girlfriend (who was NOT directly contributing to the mother's expenses or mortgage payments) somehow ended up being added to the mother's original, paid-off home title, alongside the son. Not for the new home, but for the mother's own property.
This situation is fraught with peril:
- Loss of Control: Once someone is on title, they have a legal ownership stake. The mother can no longer sell, refinance, or even make significant decisions about her home without their consent.
- Creditor Risk: If the son or his girlfriend face financial difficulties, their creditors could potentially come after their share of the mother's home.
- Relationship Breakdown: What happens if the son and girlfriend break up? The girlfriend now has a legal claim to the mother's asset. This could lead to messy legal battles and force the sale of the home.
- Tax Implications: There can be significant capital gains tax implications if the property is not the primary residence for all owners.
- Estate Planning Nightmares: This complicates wills and estate distribution immensely.
My takeaway is simple and direct: DO NOT add someone to your property title unless it is absolutely necessary and you have received independent legal advice from YOUR OWN lawyer.
Before you make any decision that involves changing ownership of your most significant asset, consult with a qualified real estate lawyer who represents YOUR interests, not the bank's, not your family member's, and certainly not a friend's 'advice'. Protecting your equity and your peace of mind is paramount. Always consult experts โ don't rely on well-intentioned but potentially disastrous advice from unqualified sources.
